DUALYS is currently offered in a test phase. The service is under continuous development: features, AI models, credit costs and characteristics may be modified, suspended or removed at any time. Interruptions, generation errors, content loss or results not matching expectations may occur. The User agrees to use the service with this awareness. Mandatory consumer rights under EU law remain unaffected.

Terms of Use

1. Service Provider

DUALYS is a digital project operated by an individual residing in Italy, operating under the Italian occasional work regime pursuant to Art. 2222 of the Italian Civil Code and Art. 67(1)(l) of D.P.R. 917/1986 (TUIR).

The service is provided without a VAT number, within the limits established by applicable law (annual compensation below €5,000). Should these thresholds be exceeded, the Owner will promptly regularize their fiscal and corporate status and notify Users accordingly.

2. Definitions

"Platform" — The DUALYS service, accessible via dualys.it and all its subdomains.
"User" — Any natural or legal person using the Platform.
"Owner" — The individual who owns and operates the Platform.
"AI Character" — The artificial intelligence entity created by the User during key activation.
"Account" — The personal credentials (email address and password) used by the User to access the Platform.
"Credit" — The unit of service usage (1 message = 1 credit).
"Generated Content" — Any text, prompt, idea or suggestion produced by the interaction between User and AI Character.

3. Acceptance of Terms

Use of the Platform implies full and unreserved acceptance of these Terms and Conditions. By checking the consent boxes during key activation, the User declares having read, understood and accepted these Terms. This acceptance constitutes a binding digital signature under Regulation (EU) No. 910/2014 (eIDAS) and applicable Italian law. The acceptance timestamp is recorded in the system.

4. Service Description and AI Transparency

DUALYS provides a conversational artificial intelligence service allowing Users to:

🤖 AI Act Notice — Regulation (EU) 2024/1689: The User acknowledges that they are interacting with an artificial intelligence system, not a human being. All content generated by the AI Character is produced algorithmically and does not represent opinions, advice or recommendations from the Owner. The system is classified as limited risk under Art. 50 of Regulation (EU) 2024/1689 (AI Act), which imposes transparency obligations toward the User.

The service directly generates images and videos through artificial intelligence, using third-party models (including Atlas Cloud, OpenRouter, Google Veo, Google Nano Banana, PixVerse). Generated content is produced algorithmically upon the User's instruction. The Provider is not responsible for the use the User makes of generated content nor for its distribution on third-party platforms.

Pursuant to Art. 50 of Regulation (EU) 2024/1689 (AI Act), the User is informed that all content produced by the Platform is generated by artificial intelligence systems and does not represent reality. Content depicting real persons is subject to the GDPR and applicable criminal law — the User assumes full legal responsibility for its use.

5. Registration and Account

Registration of an account with an email address and password is required to use the Platform. Credentials are personal, non-transferable and non-assignable. The User is solely responsible for safeguarding their credentials and for all activity conducted through their account. The AI Character name chosen during activation is permanent and cannot be changed.

6. Plans, Payments and Invoicing

The Platform offers various usage plans (Free, Pro, Business, Unlimited) with different credit limits, features and memory capabilities.

7. Intellectual Property

The Platform, its source code, design, architecture, trademarks and all original content are the exclusive property of the Owner, protected by Italian copyright law (L. 633/1941), the Italian Industrial Property Code (D.Lgs. 30/2005) and international intellectual property regulations (Berne Convention, TRIPS).

Generated Content from User-AI interactions belongs to the User, within the limits permitted by applicable law and considering the algorithmic nature of the generation. The User may use it freely, including for commercial purposes, at their own risk and responsibility. The Owner claims no rights over Generated Content.

The Owner is not liable for:

The service is provided "as is", to the extent permitted by applicable law. For consumers residing in the European Union, liability limitations apply within the bounds of Directive (EU) 2019/770 (digital content and services) and its national implementations, which guarantee minimum conformity requirements for digital services.

10. Legal Guarantee of Conformity (EU Consumers)

Under Directive (EU) 2019/770, digital services must conform to the contract. In case of lack of conformity, the consumer is entitled to have the digital service brought into conformity. The Owner is liable for any lack of conformity that becomes apparent within 2 years of service provision. The Owner commits to providing necessary updates to maintain service conformity throughout the supply period.

11. Suspension and Termination

The Owner reserves the right to suspend or terminate User access in case of: Terms violations; abusive or fraudulent use; security compromise attempts; generation of manifestly illegal content. Suspension may occur without prior notice for serious violations. For minor violations, the Owner will provide notice and a reasonable timeframe to cease the conduct. The User may stop using the service at any time.

12. Right of Withdrawal (Consumers)

Under Articles 52-59 of Italian D.Lgs. 206/2005 (Consumer Code), consumer Users have the right to withdraw from the contract within 14 days of purchase, without providing any reason.

How to withdraw: Send an explicit communication to support@dualys.it including: name or access key identifier, purchase date, declaration of intent to withdraw.

Refund: The Owner will process the refund within 14 days of receiving the withdrawal communication, using the same payment method used for the purchase, unless otherwise agreed.

Exception: The right of withdrawal does not apply if the digital service has been fully performed with the User's express consent and explicit acceptance of the loss of the right of withdrawal before performance began.

13. Modifications

The Owner may modify these Terms at any time. Changes will be communicated via the Platform with at least 15 days' notice before taking effect. Continued use after changes take effect constitutes acceptance. For substantial modifications, the User may withdraw free of charge within 30 days of notification.

14. Governing Law and Jurisdiction

These Terms are governed by Italian law.

For consumers residing in Italy, the competent court is the court of the consumer's place of residence or domicile (Art. 66-bis D.Lgs. 206/2005).

For consumers residing in the European Union, the mandatory consumer protection rules of their country of residence apply where they offer greater protection.

For professional users (B2B), the competent court is the Owner's court of residence.

15. Provisions for Non-EU Users

15.1 United States Residents

For California residents, the rights under the California Consumer Privacy Act (CCPA/CPRA) apply as detailed in the Privacy Policy. DUALYS does not sell personal data to third parties under the CCPA.

15.2 United Kingdom Residents

For UK residents, personal data processing complies with the UK GDPR and the Data Protection Act 2018.

15.3 Swiss Residents

For Swiss residents, the new Federal Act on Data Protection (nFADP/DSG), effective September 1, 2023, applies.

15.4 Brazilian Residents

For Brazilian residents, the rights under the Lei Geral de Proteção de Dados (LGPD) apply.

15.5 General Clause

For users in jurisdictions not expressly mentioned, these Terms apply to the extent they do not conflict with local mandatory consumer protection and data privacy laws.

16. Digital Services Act — Single Point of Contact (Reg. EU 2022/2065)

Pursuant to Art. 11 of Regulation (EU) 2022/2065 (Digital Services Act), the Owner provides the following single point of contact for Member State authorities, the European Commission and the European Board for Digital Services:
